1. Introduction
Welcome to Appsetup Popups (“the App”), a tool designed to help merchants create, manage, and customize interactive popups with rewards and discounts for their online stores. By installing or using the App, you (“User” or “Merchant”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not install or use the App.
2. Acceptance of Terms
By using the App, you confirm that you have read, understood, and agree to these Terms. These Terms govern your access to and use of the App and any services provided by Appsetup Popups.
3. Description of the App
Appsetup Popups is provided “as is” and is intended to allow merchants to:
Create and manage interactive popups that offer fixed rewards or link to multi-reward campaigns.
Configure various settings for popups including content, appearance, targeting rules, frequency, and trigger conditions.
Monitor performance metrics such as popup impressions and subscriber counts.
Configure reward settings, including percentage discounts, free shipping, or free product offers, using a weighted chance system.
Reward Mechanism Details
Fixed Rewards: Every customer who completes a popup interaction will receive the same reward (i.e., a 100% win rate). Fixed reward types include:
Percentage Discount: A preset discount (e.g., 10% off) applied automatically at checkout.
Free Shipping: Free shipping on the customer’s order.
Free Product: A specific product is awarded at a 100% discount and added to the cart as a free item. Important: Only one unit of a free product is given per interaction. The app automatically prevents additional free units from being added—any extra quantity is removed at checkout and the quantity selector for that item is disabled.
Campaign Rewards: Alternatively, you may link a popup to a campaign. In this mode, rewards are selected using a weighted random algorithm. You assign each reward a percentage chance (which must total 100% across all rewards). For example, if one reward is set at 40% and another at 60%, then on average, 40% of interactions will yield the first reward and 60% the second. Note: Due to randomness, rewards with very low percentages (e.g., 1%) might rarely be won. Each roll is independent and the chance remains as configured; however, statistically, a low chance reward might require many interactions before it appears. Disclaimer: Appsetup Popups calculates reward probabilities based on your settings, but the outcome is determined by chance. We are not responsible for any revenue loss or issues arising from the reward selection process.
4. Data Storage and Privacy
4.1 Data Storage
Customer data collected through the App (such as email addresses and interaction metrics) is saved via the merchant’s Shopify metafields. This means that while the App facilitates data collection and processing, all data is stored within your store’s environment.
4.2 Privacy Responsibility
You are solely responsible for managing and securing any customer data in accordance with applicable privacy and data protection laws. The App does not store or process customer data on its own servers.
5. User Responsibilities
As a User, you acknowledge and agree that:
You are solely responsible for configuring and verifying all popup settings, reward configurations, and campaign rules before deployment.
You must carefully review the reward settings—especially for Fixed Rewards—since any reward configured (including percentage discounts, free shipping, or free product offers) will be applied automatically to every customer interaction.
In campaigns where rewards have weighted probabilities, you must ensure that the total chance values sum to 100% and understand that rewards with lower percentages may be won very rarely.
You are responsible for verifying that any discounts, free shipping, or free products are acceptable for your business model and store policies.
You must ensure that all customer information collected via the App is handled in compliance with applicable privacy and data protection laws.
6. Reward and Campaign Disclaimer
Fixed Rewards: Every customer who completes the popup interaction will receive the configured fixed reward. Important: Verify the fixed reward carefully before deploying the popup. For example, if you choose the Free Product option, customers will win exactly one unit of the product per interaction.
Campaign Rewards: Rewards in a campaign are determined by a weighted random algorithm based on the percentages you set. Although every reward has a chance to drop, a reward with a very low percentage may require many attempts before it is won.
Independent Outcome: Each reward roll is independent. The probabilities you set (e.g., 40% vs. 60%, or 0.1% vs. 0.9% vs. 99%) dictate the average outcomes, but there is no guarantee for any single interaction.
No Guarantee: The App calculates reward chances based on your configuration, but the actual outcome is determined by random chance. Appsetup Popups is not responsible for any discrepancies or issues arising from the reward selection process.
7. Limitation of Liability
To the fullest extent permitted by law, Appsetup Popups, its affiliates, and its suppliers shall not be liable for:
Any indirect, incidental, special, or consequential damages (including loss of revenue, profit, or data) arising from your use or inability to use the App.
Any damages resulting from the configuration, deployment, or management of popups and campaigns, including errors in reward settings.
Any consequences arising from the randomness inherent in the reward selection process.
8. Indemnification
You agree to indemnify and hold harmless Appsetup Popups and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the App or your violation of these Terms.
9. Modifications to Terms and Conditions
Appsetup Popups reserves the right to modify these Terms at any time. Updated Terms will be posted on our website or within the App, and your continued use of the App after any changes have been posted constitutes your acceptance of the revised Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Appsetup Popups is incorporated, without regard to its conflict of law provisions.
11. Support and Removal of Branding
11.1 Powered By Branding
As the App is offered for free, the default configuration includes a “Powered by Appsetup Popups” branding on each popup.
11.2 Removal Process
If you wish to remove the Powered By branding, please note that this feature is disabled by default and requires support assistance. When you click the corresponding checkbox in the General Settings, an in-app chat window will open for you to contact support. Our team will work with you—typically within one hour—to enable this setting. We thank you for your understanding and support.
12. Reward Creation and Customer Responsibility
Reward Generation: The App automatically generates discounts and rewards when a customer completes a popup form.
Campaign Rewards: When using campaign rewards, the App uses a weighted random algorithm to select a reward based on the percentages you configure.
Customer Data and Reward Fulfillment: All customer data is saved via the merchant’s Shopify metafields, and rewards are applied automatically. Appsetup Popups is not liable for any issues related to the frequency of rewards being won or for discrepancies in reward fulfillment.
No Responsibility for Overuse: Appsetup Popups is not responsible if rewards are won more frequently than expected. It is your responsibility to configure reward chances appropriately for your business model.
13. Disclaimer on Reward Chance Calculations
The reward chance algorithm used in the App is similar in principle to those found in popular video games and loot systems, where rewards are assigned weighted probabilities.
Each reward’s chance is based on the percentage value you set; for example, if you set one reward at 40% and another at 60%, then on average, 40% of interactions should yield the first reward and 60% the second.
However, randomness means that in any given instance, even a reward with a 1% chance might not be won for an extraordinarily large number of interactions.
The ordering of rewards in your configuration does not affect their probabilities; only the percentage values you assign matter.
Important: Appsetup Popups is not responsible for any perceived imbalance in reward distribution due to the inherent randomness of the selection process.
14. Acknowledgment
By using Appsetup Popups, you acknowledge that you have read these Terms and agree to be bound by them. You further agree that you are solely responsible for your configurations, data management, and compliance with all applicable laws and store policies.
